Frequently asked questions

Does a company have to give its domestic worker a contract?

Yes. Section 29 of the BCEA requires written particulars of employment for every employee, including domestic workers employed by a company. A signed contract is the simplest way to comply.

Who signs on behalf of the company?

An authorised signatory — usually a director, member or trustee. The contract names the company as the employer and shows the signatory signing for and on behalf of it.

Does the company need to register for UIF?

Yes. The company must register as an employer with the UIF and pay 2% of the worker's pay each month — 1% from the company and 1% deducted from the worker.

How much notice must either side give?

Four weeks, where the domestic worker has been employed for longer than six months, in line with the BCEA notice rules for farm and domestic workers.
