Frequently asked questions
Can a general power of attorney be used to sell property?
No. Transferring immovable property requires a special power of attorney in the form prescribed by the Deeds Registries Act. Use our Special Power of Attorney for that.
Does a power of attorney survive mental incapacity?
No. Under South African law a mandate lapses when the principal becomes mentally incapable. A curatorship or administrator under the Mental Health Care Act is then required.
Must it be signed in wet ink?
Not always. The parties may sign electronically under section 13 of ECTA, but a bank, court or statutory body may still require an original signed in wet ink. The document includes two witness lines for physical execution.
