Frequently asked questions

Can a general power of attorney be used to sell property?

No. Transferring immovable property requires a special power of attorney in the form prescribed by the Deeds Registries Act. Use our Special Power of Attorney for that.

Does a power of attorney survive mental incapacity?

No. Under South African law a mandate lapses when the principal becomes mentally incapable. A curatorship or administrator under the Mental Health Care Act is then required.

Must it be signed in wet ink?

Yes — sign it by hand in front of two competent witnesses. Banks and the Deeds Office will not accept an electronically signed general power of attorney.
