Having a written domestic worker contract in South Africa is not just good practice; it is a legal requirement under Section 29 of the Basic Conditions of Employment Act (BCEA). Here is what you need to know to ensure fair employment and total legal compliance.

The National Minimum Wage for Domestic Workers

Historically, domestic workers were subject to a lower sectoral wage determination. Today, domestic workers are entitled to 100% of the National Minimum Wage (NMW).

When budgeting for your domestic worker, keep these wage basics in mind:

  • Hourly rate: You must pay at least the current statutory NMW hourly rate for every hour worked.
  • Transport and meals: You cannot deduct the cost of meals, uniforms, or work equipment to bring cash wages below the minimum wage threshold.
  • Accommodation deductions: If you provide accommodation, deductions are capped at 10% of the employee's total wage under the BCEA Sectoral Determination 7, provided the room meets basic structural, safety, and privacy standards.

Essential Terms for Your Domestic Worker Contract

A comprehensive employment agreement protects both parties and sets clear day-to-day expectations. Your contract should cover:

  • Job description: Clear outline of core responsibilities, such as cleaning, laundry, cooking, or childcare.
  • Working hours: Standard hours cannot exceed 45 ordinary hours per week (or 9 hours per day for a five-day work week, 8 hours per day for a six-day work week).
  • Overtime and Sunday work: Overtime must be agreed in advance and paid at 1.5 times the normal rate, while Sunday work is paid at double time unless Sundays form part of normal rostered hours.
  • Leave entitlements: Full-time staff are entitled to 21 consecutive days (or 15 working days) of paid annual leave per year, alongside statutory sick leave, family responsibility leave, and maternity leave.
  • Notice periods: The BCEA mandates one week's notice for the first six months of employment, and four weeks' notice after six months.

Registration for UIF and COIDA

If your domestic worker works for you for more than 24 hours per month, you are legally required to register as an employer with the Unemployment Insurance Fund (UIF) and register your worker. The contribution is 2% of the gross salary monthly (1% contributed by you and 1% deducted from their wage).

Additionally, following recent Constitutional Court rulings, domestic workers are covered by the Compensation for Occupational Injuries and Diseases Act (COIDA). You must register with the Compensation Commissioner to ensure cover if an injury occurs on your property.

Avoid Costly CCMA Disputes

Many household employers rely on verbal agreements or informal handshakes. When misunderstandings arise around leave balances, wage expectations, or performance issues, the Commission for Conciliation, Mediation and Arbitration (CCMA) rarely rules in favour of an employer without clear written documentation.
