- How much notice must be given under the BCEA?
- Section 37 of the Basic Conditions of Employment Act requires one week's notice during the first six months of employment, two weeks after six months, and four weeks after one year. Farm workers and domestic workers employed for more than six months must be given four weeks.
- How is unused annual leave paid out?
- Section 40 requires the employer to pay the employee for any annual leave that accrued but was not taken. Leave accrues at one day for every 17 days actually worked, which works out to 21 consecutive days (15 working days on a five-day week) per annual leave cycle.
- Can notice be paid instead of worked?
- Yes. An employer may pay the employee the remuneration they would have received for the notice period instead of requiring them to work it, but notice may not be given during, or run concurrently with, any period of leave other than sick leave.
