Is a written employment contract compulsory in South Africa?

Section 29 of the BCEA requires written particulars of employment to be given to the employee when they start work. A signed contract is the simplest way to comply.

How long may a probation period be?

The BCEA does not fix a period. Schedule 8 requires probation to be of reasonable length for the job — typically three months for junior roles and up to six for senior positions, with evaluation and guidance during the period.

What notice period applies?

One week in the first six months, two weeks up to a year of service, and four weeks after a year (or for farm and domestic workers after six months).
