Frequently asked questions

Can an Offer to Purchase be signed electronically?

An ordinary electronic signature is legally exposed for a land-sale agreement because the ECT Act excludes agreements for the alienation of immovable property. This template therefore requires wet-ink signatures, unless a conveyancer approves an appropriate advanced signature process.

Does every purchaser get a five-day cooling-off period?

No. Section 29A is limited, including to a natural-person purchaser and a purchase price not exceeding the statutory R250,000 threshold. The clause appears only when those requirements are met.

Must the disclosure form be attached?

Where a property practitioner is involved, the prescribed completed disclosure form should be given before the agreement is concluded and attached as an annexure. The generator lets the purchaser append that PDF privately.
