Frequently asked questions
Is an indemnity form legally binding in South Africa?
Yes, if it is signed voluntarily, written in plain language and the risk clauses are drawn to the signer's attention before the activity. Section 51 of the Consumer Protection Act means it can never exclude liability for gross negligence or for deliberate harm.
Can a minor sign an indemnity?
No. A participant under 18 cannot validly waive their rights. A parent or legal guardian signs on their behalf, and the form records the guardian's details and consent.
Does it cover photographs and personal information?
