Can I sell a car voetstoots in South Africa?
A private seller can. Voetstoots means the goods are sold as they stand, with all patent and latent defects. It does not protect a seller who knew about a latent defect and hid it. A dealer selling in the ordinary course of business cannot rely on voetstoots to escape sections 55 and 56 of the Consumer Protection Act.
When does the Consumer Protection Act apply to a sale of goods?
Broadly, when the seller supplies goods in the ordinary course of business to a consumer covered by the Act. It generally does not apply where the buyer is a company or trust whose asset value or annual turnover equals or exceeds the prescribed threshold, commonly stated as R2 000 000.
Can this agreement be signed electronically?
Yes. A sale of movable goods is not on the list of agreements the ECT Act excludes, so both parties can sign with the secure signing links included with your purchase, or print and sign by hand.
