Frequently asked questions
Is an acknowledgement of debt legally binding in South Africa?
Yes. A signed AOD is a contract. It records that the debtor admits the debt and accepts the repayment terms, and a signed acknowledgement also interrupts prescription under the Prescription Act, so the debt does not simply fall away after three years.
Does the National Credit Act apply to an AOD?
It can. Where the parties are not dealing at arm's length — for example a once-off loan between family members — the NCA generally does not apply. Where interest is charged in an arm's-length arrangement, the arrangement may be a credit agreement under the NCA. The generator flags this where you switch interest on, so you can take advice if needed.
Can I charge interest on the debt?
Yes, if both parties agree. The generator adds a clear interest clause recording the rate and how it is calculated. If no interest is charged, the clause is left out entirely.
Can it be signed electronically?
Yes. An acknowledgement of debt is not on the list of agreements the ECT Act excludes, so both parties can sign with the secure signing links included with your purchase, or print and sign by hand.
